This Privacy Policy ("Policy") explains how Third‑Eye Cinematics LLC ("TEC," "we," "us," or "our") collects, uses, discloses, retains, and protects personal information in connection with our websites, online accounts, portals, and our in‑person and virtual master classes, workshops, and events (collectively, the "Services").

This Policy should be read together with TEC's Terms & Conditions/Terms of Use and any event‑specific notices or consents presented to you. Where required by law, additional rights and disclosures appear in Section 11 (U.S. State Privacy Rights).

1. Scope; Roles; Definitions

1.1 Scope.

This Policy applies to personal information about individuals who visit, access, or use the Services (including prospective and registered students, account holders, and event attendees). This Policy does not cover information collected in an employment or business‑to‑business (B2B) context except where state law extends privacy rights to such data (e.g., California).

1.2 Roles.

TEC generally acts as a "business"/"controller" for information collected through the Services. If TEC processes personal information strictly on behalf of a co‑sponsor or partner, TEC acts as a "service provider"/"processor" as defined by applicable law.

1.3 Personal Information.

"Personal information" (or "personal data") means information that identifies, relates to, describes, or can reasonably be linked to an identified or identifiable individual, as defined by applicable privacy laws.

2. Information We Collect

We collect personal information from and about you in the following ways:

Information You Provide Directly: identifiers and contact details (e.g., name, email address, phone number); account credentials (e.g., username and encrypted password); registration, ticketing, and event details; preferences; surveys and feedback; voluntary media submissions (e.g., portfolio links); and communications with TEC.

Information Collected Automatically: device, network, and usage data (e.g., IP address, browser type/version, operating system, pages viewed, referring/exit pages, timestamps), collected via cookies or similar technologies for essential functionality, security, and performance. TEC recognizes certain universal opt‑out signals (such as Global Privacy Control, "GPC") where required by law.

Information from Service Providers and Partners: payment processor transaction metadata (TEC does not store full card numbers); email/SMS delivery status; limited operational data from venue partners or co‑sponsors for event administration.

3. How We Use Personal Information

  • Provide, Operate, and Support the Services (process registrations/payments; deliver classes and logistics; administer accounts; authenticate users; provide support; ensure venue and safety compliance);
  • Communicate with you (service announcements, event updates, critical notifications, and, subject to your choices, marketing communications);
  • Protect Security and Integrity (monitor use, detect/prevent fraud/abuse, maintain logs, and protect the safety of attendees and staff);
  • Improve and Develop the Services (analyze usage to enhance curricula and user experience);
  • Comply with Legal Obligations (tax, accounting, recordkeeping, and response to lawful requests).

4. To Improve and Develop Our Services, Including Analytics and AI/ML

We use the information we collect to understand how our website and master classes are used, improve performance and usability, and enhance the overall learning experience. This includes:

  • Analyzing attendance and engagement during workshops (both online and in-person).
  • Reviewing feedback and usage patterns to refine course content and scheduling.
  • Identifying technical issues and improving site functionality.
  • Developing new features and educational resources that support students and instructors.

Where permitted by law, we may create aggregated, anonymized, or de-identified datasets ("Derived Data") from registration details, usage data, and engagement metrics. We may use this Derived Data to:

  • Generate insights that help us improve our curriculum and delivery methods.
  • Train, validate, and enhance algorithms, including artificial intelligence (AI) and machine learning (ML) models, for purposes such as personalized learning recommendations, optimizing class formats, and improving user experience.

Any Derived Data we share externally will be in a form that does not identify you, except where required by law or authorized by you.

5. How We Disclose Personal Information

5.1

We do not sell personal information for money. TEC does not disclose personal information for cross‑context behavioral advertising without offering the opt‑out required by applicable law.

5.2

We may disclose personal information to:

  • Service Providers and vendors (e.g., payment, email/SMS, hosting, analytics, support) under contracts that restrict use to defined services and require appropriate safeguards;
  • Co‑sponsors and Venues (limited operational data necessary to administer a co‑hosted class or event);
  • Legal/Compliance Recipients (to comply with law, respond to lawful requests, protect rights, security, and safety).

6. Security

We maintain reasonable administrative, technical, and organizational safeguards designed to protect personal information against unauthorized access, disclosure, alteration, or destruction. While we strive to protect personal information, no system is completely secure. We ask users to protect credentials and notify us promptly of suspected account compromise.

7. Data Retention

Retention periods may vary by law, dispute resolution needs, or operational requirements and may be extended where legally permitted.

  • Active accounts: retained while your account remains active;
  • Closed accounts: generally retained up to three (3) years for records and customer service;
  • Workshop/tax records: retained up to seven (7) years for legal and tax compliance.

8. Children & Teens

The Services are generally directed to adults (18+). TEC does not knowingly collect personal information from children under 13 without verifiable parental consent in accordance with COPPA. Certain states require heightened consent or opt‑out for teens (13–16) with respect to sale/sharing/targeted advertising; TEC follows those requirements where applicable.

9.1 Marketing Opt‑Out.

You may opt‑out of marketing emails by using unsubscribe links or contacting us (Section 14).

9.2 Cookies/Tracking.

You may manage browser settings to limit or block cookies; TEC will honor GPC or similar universal opt‑out signals where required by law.

10. Do Not Track / Global Privacy Control (GPC)

Browsers and extensions may send "Do Not Track" or Global Privacy Control (GPC) signals. TEC treats GPC (or comparable universal opt‑out signals) as an opt‑out of sale/sharing or targeted advertising in jurisdictions that require recognition (e.g., CA, CO, CT, TX).

11. International Transfers

If you access the Services from outside the United States, your personal information may be transferred to and processed in the U.S. and other jurisdictions with different data protection laws than your home jurisdiction. TEC implements appropriate measures consistent with applicable requirements.

12. U.S. State Privacy Rights

Certain U.S. state laws, including, without limitation, California (CCPA/CPRA), Virginia (VCDPA), Colorado (CPA), Connecticut (CTDPA), Utah (UCPA), Texas (TDPSA), Oregon (OCPA), Montana (MCDPA), Delaware (DPDPA), New Jersey (NJDPA), Nebraska (NDPA), New Hampshire (NHDPA), and Iowa (ICDPA)—grant residents specific rights regarding personal information. TEC provides the following, consistent with applicable law:

  • Correction – Request correction of inaccurate personal information.
  • Deletion – Request deletion of personal information, subject to lawful exceptions.
  • Portability – Receive a portable copy of personal information.
  • Opt‑Out – Direct us not to: (i) Sell personal information; (ii) Share personal information for cross‑context behavioral advertising; (iii) Use personal information for targeted advertising or certain profiling activities.
  • Sensitive Data – Limit or withdraw consent for processing Sensitive Personal Information (where law requires opt‑in or permits limitation).
  • Non‑Discrimination – We will not discriminate against you for exercising these rights.

12.2 Universal Opt‑Out Signals.

Where required by law (e.g., CA, CO, CT, TX), we honor Global Privacy Control (GPC) signals as an opt‑out of sale/sharing or targeted advertising.

12.3 How to Exercise Your Rights.

Submit a request by emailing privacy@thirdeyecinematics.com or mailing us at the address in Section 14. We will verify your identity and respond within the timeframes required by law (typically 45 days). If we deny your request, you may appeal by emailing us with "Privacy Appeal" in the subject line.

13. Event Media; Photography & Recording

TEC may film, photograph, or otherwise record events for archival, educational, and promotional purposes. Images and recordings may constitute personal information. If you do not wish to be photographed or recorded, please notify TEC in writing during registration or at check‑in; TEC will use reasonable efforts to accommodate requests consistent with event logistics and safety protocols.
