PARTICIPANT WAIVER & RELEASE

IMPORTANT: Please read carefully before registering for the workshop.

1. ACKNOWLEDGMENT OF RISKS

I understand and acknowledge that participation in the Third‑Eye Cinematics (TEC) cinematography master class, workshop, and any related activities ("Event") involves inherent risks, including but not limited to: handling cameras, lighting equipment, electrical cables, grip gear, and other filmmaking tools; physical activity during on‑location shooting, equipment setup/strike, and movement in variable environments; potential for equipment damage or malfunction; interaction with other participants, instructors, and venue staff; and travel to/from Event venues and shooting locations.

2. ASSUMPTION OF RISK

I voluntarily assume all risks (known and unknown) associated with my participation in the Event and understand such risks could result in personal injury, illness, property damage, or other loss. I agree to follow all posted and verbal safety instructions and to use equipment responsibly.

3. RELEASE, WAIVER, AND COVENANT NOT TO SUE

To the fullest extent permitted by North Carolina law, and in consideration of being allowed to participate in the Event, I hereby release, waive, discharge, and covenant not to sue TEC, its owners, officers, employees, instructors, contractors, and agents; workshop instructors; venue owners/lessors/operators; equipment providers, sponsors, and affiliated organizations from any and all claims, demands, actions, or causes of action arising out of or related to injury, illness, death, property loss, or damages sustained during or resulting from my participation in the Event, except to the extent caused by TEC's gross negligence or willful misconduct.

4. INDEMNIFICATION

I agree to indemnify, defend, and hold harmless TEC and the Released Parties from any and all claims, actions, suits, liabilities, losses, costs, and expenses (including reasonable attorneys' fees) arising out of: (a) my breach of this Waiver, the Event rules, or TEC's Terms & Conditions; (b) my negligence or misconduct; (c) injury to persons or damage to property caused by me; and (d) any violation of third‑party rights (including intellectual property) in connection with works I create during TEC activities.

5. MEDICAL TREATMENT AUTHORIZATION

If I experience illness or injury during the Event, I authorize TEC staff and instructors to summon emergency responders and secure necessary medical treatment; arrange transport to an appropriate medical facility; and contact the emergency contact(s) listed in my registration. I understand I am solely responsible for all resulting medical costs and expenses.

6. EQUIPMENT USE & RESPONSIBILITY

I will use all equipment safely and as instructed by TEC staff/instructors. I am responsible for equipment assigned to me during the Event. I will promptly report any damage, loss, or malfunction. I may be liable for repair or replacement costs resulting from my negligence, misuse, or failure to follow instructions. I shall not remove equipment from designated areas without permission.

7. MEDIA RELEASE; OPT‑OUT PROCESS

I grant TEC a non‑exclusive, royalty‑free, worldwide, perpetual license to use photographs, video, and audio recordings captured during the Event that include my image/likeness/voice for archival, educational, and promotional purposes, including TEC's website, social media, and marketing materials, without additional compensation. Opt‑Out: If I do not wish to be photographed or recorded, I must notify TEC in writing before the Event at registration; TEC will make reasonable efforts to accommodate such requests consistent with logistics and safety requirements.

8. RECORDING POLICY

I will not record, livestream, photograph, or capture any portion of the class (including audio, video, screenshots) without TEC's prior written permission. TEC may require deletion of unauthorized recordings and may remove violators from the Event without refund. TEC may record sessions for internal quality assurance and educational purposes, consistent with the Privacy Policy.

9. INSURANCE; PERSONAL PROPERTY

TEC does not provide health, accident, or equipment insurance for participants. I am responsible for obtaining my own coverage as desired. I am responsible for my personal property; TEC is not liable for loss, theft, or damage to personal belongings.

10. COMPLIANCE WITH RULES

I agree to comply with all Event rules, safety guidelines, venue regulations, and instructions from TEC staff and instructors. TEC may remove any participant who violates rules or engages in unsafe or disruptive conduct, without refund.

11. DISPUTE RESOLUTION; MANDATORY MEDIATION; ARBITRATION; CLASS WAIVER

If any dispute arises out of or relates to this Waiver or the Event: (a) Informal Resolution: The parties will attempt to resolve the dispute informally for 30 days. (b) Mandatory Mediation: If unresolved, the parties must engage in good‑faith mediation for at least 30 days, conducted virtually or in Wake County, North Carolina, unless otherwise agreed in writing. (c) Binding Arbitration: If mediation does not resolve the dispute, the matter will be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer/Commercial Rules, before a single arbitrator. The seat and venue of arbitration will be Wake County, North Carolina, and the arbitration will be governed by the Federal Arbitration Act. (d) Class Action Waiver: Disputes will be resolved only on an individual basis. Class, consolidated, or representative actions are not permitted.

12. GOVERNING LAW; VENUE

This Waiver is governed by the laws of the State of North Carolina, without regard to conflict‑of‑laws principles. Subject to the arbitration provisions above, any permitted court action shall be brought exclusively in the state or federal courts located in Wake County, North Carolina.

13. PRIVACY

I understand my personal information will be processed in accordance with TEC's Privacy Policy and Terms & Conditions, which are incorporated by reference. I may exercise applicable privacy rights as described in the Privacy Policy.

14. SEVERABILITY; ENTIRE AGREEMENT; ELECTRONIC SIGNATURE

If any provision of this Waiver is found unenforceable, the remaining provisions remain in full force and effect. This Waiver, together with TEC's Privacy Policy and Terms & Conditions, constitutes the entire agreement regarding the subjects addressed herein. I agree that checking the Waiver box or e‑signing during registration constitutes my electronic signature and acceptance.

15. ACKNOWLEDGMENT

By checking the liability waiver box during registration or signing below, I acknowledge: I have read and understand this Waiver and agree to its terms; I am at least 18 years of age (or have parental/legal guardian consent as required); This Waiver is legally binding on me and my heirs, executors, and personal representatives.
